Terms of Service for Lychee

Agreement to Terms

By downloading, installing, or using the Lychee mobile application ("App," "Service," "we," "our," or "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms form a legally binding agreement between you and Lychee.

1. Description of Service

Lychee is a product scanner and ingredient explainer for food and cosmetic products. The App may help you:

Lychee is not a medical service, allergy-management service, diet program, nutrition coach, cosmetic safety certification service, or substitute for reading product labels yourself.

We may collect limited usage analytics through PostHog and limited advertising attribution events through the Meta/Facebook SDK to monitor performance, understand onboarding and feature usage, measure ad campaign performance, and improve the Service as described in our Privacy Policy.

2. Eligibility and Account

You must be at least 13 years old, or 16 years old if you are in the European Economic Area where required, to use the App. If you are a minor, you must have permission from a parent or guardian.

Lychee does not currently require user registration. Most day-to-day App data is stored locally on your device.

3. License and Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes.

Subscription pricing, trial availability, and billing period are shown in the App. Payment is processed through the Apple App Store or Google Play Store. Subscription status and entitlement management may be handled through RevenueCat. We do not store your full payment card details.

If a free trial is offered, it automatically converts to a paid subscription unless canceled before the trial ends. Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. You can manage or cancel subscriptions through your App Store or Google Play account settings.

Refunds are handled by Apple or Google under their own refund policies. We cannot guarantee refunds.

9. Intellectual Property

The App and its content, features, design, code, branding, databases, and algorithms are owned by Lychee or its licensors and are protected by intellectual property laws.

10. Privacy and Data

Your privacy is governed by our Privacy Policy, which is incorporated into these Terms.

11. Advertising

Free users may see advertisements served by Google AdMob. Ads may be selected based on device information, app context, and other information handled by Google according to its policies.

We may use the Meta/Facebook SDK to measure whether Instagram/Facebook ads lead to installs, trials, checkout, or subscription events.

To remove in-app ads, subscribe to Premium if available.

12. Termination

You may stop using the App at any time by uninstalling it and canceling any active subscription.

We may suspend or terminate access to the Service at any time if you violate these Terms, misuse the App, submit unlawful content, fail to pay for Premium, or if we discontinue the Service.

Sections that by nature should survive termination will survive, including disclaimers, limitations of liability, intellectual property, privacy, product contribution rights, and dispute provisions.

13. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied.

To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, completeness, uninterrupted operation, and error-free operation.

To the maximum extent permitted by law, we are not liable for direct, indirect, incidental, consequential, special, punitive, or exemplary damages; loss of data; loss of profits; personal injury; illness; death; emotional distress; or damages arising from use of or inability to use the App.

Nothing in these Terms creates liability where the law does not impose it, and nothing limits rights that cannot legally be limited. If, despite the disclaimers above, applicable law allows a claim and requires us to be responsible, our total liability will not exceed the amount you actually paid Lychee for Premium in the 3 months before the claim. If you used only free features, our total liability is limited to $10, unless applicable law requires otherwise.

14. Indemnification

You agree to indemnify, defend, and hold harmless Lychee, its affiliates, officers, directors, employees, and agents from third-party claims, damages, losses, liabilities, and expenses arising from your misuse of the App, your violation of these Terms, your violation of law, your violation of third-party rights, content you submit, or your use of App information to advise someone else as if it were professional medical, nutrition, allergy, cosmetic, or safety advice.

15. Dispute Resolution

These Terms are governed by the laws of the Republic of Poland, without regard to conflict of law principles.

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally.

For U.S. users, disputes may be resolved through binding arbitration where enforceable, rather than in court, except for small claims court matters, intellectual property disputes, and injunctive relief requests. You agree to resolve disputes individually and not as a class action where permitted by law.

For non-U.S. users, disputes will be resolved in the courts of the Republic of Poland unless applicable law requires otherwise.

17. Changes to Terms

We may update these Terms from time to time. We will update the "Last Updated" date and may provide in-app notice for material changes. Continued use of the App after changes means you accept the updated Terms.
